PUBLIC HEARING NOTICE FOR KAN STEP COMMUNITY DEVELOPMENT BLOCK APPLICATION
The City of Cherryvale, Kansas will hold a public hearing on Monday, July 19, 2010, at 7PM as part of its regular city council meeting at the City Office located at 123 W. Main, for the purpose of considering an application to be submitted to the Kansas Department of Commerce for Small Cities Community Development Block Grant funds under the KAN STEP Community Improvement category. A specific project application to be discussed is the rehabilitation of the old Armory building located at 712 S. Liberty at Cherryvale in order for the building to become a community center. The estimated project cost is about $500,000 (if done by a contractor) with the grant request for a maximum of $300,000 due to the at least 40% savings in cost due to community provided volunteer labor and donated materials. Any additional cost, if any, will be borne by the city. Other project proposals introduced at the hearing will also be considered. Oral and written comments will be recorded and become a part of the city’s CDBG Citizen Participation Plan.

A RESOLUTION ADOPTED PURSUANT TO CHAPTER 5, ARTICLE 8, OF THE CODE OF THE CITY OF CHERRYVALE, KANSAS, FINDING THAT CERTAIN STRUCTURE(S) DESCRIBED HEREIN ARE UNSAFE AND DANGEROUS.
WHEREAS, the Enforcing Officer of the City of Cherryvale, Kansas has filed a statement in writing that the following described structure is unsafe or dangerous, to-wit:

NOW THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE
CITY OF CHERRYVALE, KANSAS:
SECTION 1. The Governing Body of the City finds that such structure is unsafe or dangerous. Further, that the owner presented no evidence to the contrary at the hearing.
SECTION 2. The owners are hereby directed that the structure is to be repaired or removed and the premises made safe and secure.
SECTION 3. The owners did not appear or present evidence regarding the repair of the structure and the Governing Body orders that the building shall be removed or repaired by September 7, 2010.
SECTION 4. If the owners of such structure fail to commence the repair or removal of such structure within the time stated or fails to diligently prosecute the same until the work is completed, the governing body will cause the structure to be repaired or razed and removed in the case of unsafe or dangerous structures or rehabilitated in the case of abandoned property.
SECTION 5. This resolution shall be published once in the Montgomery County Chronicle, the official city newspaper.
SECTION 6. The City Clerk of the City of Cherryvale, Kansas, is hereby directed to mail a true and correct certified copy of the within Resolution by certified mail within three days after the date of first publication hereof to each owner, agent, lien holder and occupant at the last known place of residence of each marked “Deliver to Addressee Only”.
