These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by Montgomery County.

REQUEST FOR RELEASE OF FUNDS
Because these funds are needed on an emergency basis due to a declared disaster, the local and state comment periods have been combined. On or after January 16th, 2009, Montgomery County will submit a request to the State of Kansas for the release of Federal funds from the Community Development Block Grant Program under Title I of the Housing and Community Development Act of 1974, as amended (PL 93-383) to undertake the following project:
Project Number: Urgent Need CDBG Grant
Project Name: FEMA Flood Buy-Out
Project Type: This project will consist of participating in the FEMA Flood Buy-out that is available to homeowners affected by the June 30, 2007 flood. Assistance will be in the form of acquisition, demolition and relocation.
Project Location: The location of the project consists of an area designated by a flood map kept at County Clerk’s Office. Generally, the location is within the boundaries of Montgomery County, Kansas.
Estimated HUD/CDBG Funds: $413,815
Estimated Total Project Cost: $1,987,526

FINDING OF NO SIGNIFICANT IMPACT
Montgomery County has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at Montgomery County Clerk’s Office, 217 Myrtle, Independence, Kansas and may be examined or copied weekdays 8:00 AM to 5:00 PM.

PUBLIC COMMENTS
Because these funds are needed on an emergency basis due to a declared disaster, the local and state comment periods have been combined. Any individual, group, or agency may submit written comments on the ERR to the : Montgomery County Clerk’s Office, 217 Myrtle, Independence, Kansas, 67301 and the Kansas Department of Commerce, CDBG Program, 1000 SW Jackson Street, Suite 100, Topeka, KS, 66612. All comments received by January 16th , 2009 will be considered by Montgomery County and the Kansas Department of Commerce, CDBG Program, before the State of Kansas approves the request for release of funds. Comments should specify which Notice they are addressing.
