More than one month after Montgomery County voters went to the polls for an election, those same county voters will soon prepare for another election cycle.
The dates for the city council, school board and community college elections are now set with the deadline to file for office to be noon Tuesday, Jan. 27. Should three or more candidates seek the same office, then a primary election will be held on Tuesday, March 3.
A general election will be held on Tuesday, April 7.
Persons interested in filing for any of the city council, school board or college trustee positions listed below can fill out necessary papers at the Montgomery County Clerk’s Office in Independence or at any city hall in Montgomery County.
Listed below are the offices (and their current holders) that will be up for election in the upcoming election cycle.
• USD 436-Caney Valley Board of Education: There are three positions to be decided in the 2009 election cycle. They include the offices now held by Sherry Rackliff (District A, Position 1), Tim Rigdon (District B, Position 3), and a position that was left vacant with the recent resignation of board member David Young (District A, Position 2).
The positions now held by board members Suellen Holtzman, Debbie Morrison, David Deal and Jack Kopfman will not be decided until the 2011 election cycle.
School board members serve four-year terms, which begin in July after their election.
• USD 445-Coffeyville Board of Education: Three members of the USD 445-Cofeyville Board of Education will have their seats decided in the spring 2009 elections. Those positions are now held by Cathy Schald, Helen Ellerman and Jerry Hamm. The positions now held by Larry McGinnis, Gene Brownlee, Denise Gates and Mike Mason will be decided in the 2011 election cycle.
School board members serve four-year terms, which begin in July after their election.
• USD 446-Independence Board of Education: Three members of the USD 446-Independence Board of Education will be up for election in the spring 2009 elections. They are Jeff Chubb, Jim Kelley and Cindi Sherwood. The seats now held by board members Sherry Epp, Tom Schroeder, Carole Farthing, and Marty Reichenberger will not be decided until the spring 2011 election cycle.
School board members serve four-year terms, which begin in July after their election.
• USD 447-Cherryvale Board of Education: There are four positions to be decided in the 2009 election cycle. Those positions are now held by Lance Carter, Tina Cunningham, Bruce Thornton and Gina Booe.
The positions held by board members Sharon Wadman, Cody Smith and Michelle Loganbill will not be decided until the 2011 election cycle.
School board members serve four-year terms, which begin in July after their election.
• Cherryvale City Co
uncil: There are two positions on the Cherryvale City Council to be decided in the 2009 election cycle. They are the seats held by councilors Chad Wickham (ward 1) and Jerry Wallace (ward 2). Wallace indicated at the Cherryvale City Council meeting on Monday night, Dec. 15, that he will not seek re-election to the council.
The positions now held by councilors Randy Wagoner (ward 2) and Kevin Crane (ward 1) as well as Mayor John Wright will not be decided until the 2011 election cycle.
City councilors serve four-year terms, which begin in the first regularly-scheduled meeting following their April election.
• Caney City Council: There are five total positions to be determined in the 2009 election cycle. Those council positions are now held by Ron Wade (ward 1), Joe Taylor (ward 2), Kelly McIntosh (ward 3), and Carol McClure (ward 4). The position of mayor, now held by Dale McBride, will also be decided in the 2009 election.
The positions now held by councilors Erin Munday (ward 1), Penny Coy (ward 2), Jason Moore (ward 3) and Chad Bradford (ward 4) will not be decided until the 2010 election cycle.
City councilors and mayor serve two-year terms. Their terms of service begin at the April council meeting following the general election.
• Coffeyville City Commission: There will be three members on the five-member city commission whose terms of service will expire with the 2009 spring elections. Those positions are now held by Virgil Horn (four-year term), Richard Gonzales (four-year term) and Pam Jones (two-year term). The positions now held by commissioners Alec Hendryx and R.J. Warren will not be decided until the 2011 election cycle.
• Independence City Commission: Two members of the three-member Independence City Commission will face re-election prospects in the 2009 elections. Those two commissioners are Rick Mott and Debra Coy. The commission post now held by Darrel Unruh will not be decided until the 2011 election cycle.
City commissioners serve four-year terms.
• Independence Community College: There will be four positions considered for Independence Community College trustees in the spring 2009 election cycle. Three of those positions are now held by Norman Chambers, Tom Tyler and Dan Dollison. A fourth position is held by Lisa Drumeller. She was appointed in October to the unexpired term of Kevin Kaff. Because more than one-half of Kaff’s term was remaining when Drumeller was appointed to the election, the position will be considered for election to complete the final two years of that position. The position will then revert back to a regular four-year term in 2011.
The positions now held by board members Jay Jones and Kenny Wilson will be decided in the 2011 election cycle
College trustees serve four-year terms, which begin in July following the April election
• Coffeyville Community College: Three members of the CCC board of trustees will have their positions expire in 2009. Those trustees are Blake Allen, Gilmer Nellis and Becky Medley. The positions now held by Buck Walton, Lue Barndollar and Sherri Melander will not expire until 2011.
College trustees serve four-year terms, which begin in July following the April election.

CANEY — A member of the Caney City Council will soon resign in order to accept employment with the Caney Police Department.
Ron Wade, a ward 1 city councilor, announced Monday that he would be leaving his current job as a detective with the Montgomery County Sheriff’s Department and accept a job as a police officer with the Caney Police Department. At a special council meeting at Caney City Hall on Monday, councilors gave unanimous approval to Wade being named a police officer effective Jan. 10.
Wade had served with the local police force in the early 1990s before working with the Montgomery County Sheriff’s Department in several capacities.
Councilors said they were glad to have Wade back in the local department.
“I think Ron would be a great asset to our department,” said councilor Joe Taylor. “He has a lot of knowledge in drug investigations.”
Police chief Rick Pell also said he was excited to bring Wade’s breadth of law enforcement experience to the Caney department.
“When I told our officers that Ron wanted to come back to the department, they were really excited to hear the news,” said Pell. “They look to Ron as a mentor.”
Because laws prohibit city employees from serving on the city council, Wade will have to resign his position as ward 1 councilor. A replacement will be named by the council at a later date.
In other business transacted at Monday’s special council meeting, councilors delayed a decision on a bid to begin the third phase of the Caney City Hall project. The third phase involves the construction of a council chamber/municipal courtroom.
The council received a bid from Chris Uber of Uber Construction for the erection of the walls and roof at a cost of $90,000. Placement of the glass windows will cost an additional $5,000.
The bid does not include the exterior treatment, which calls for the facility to have the same slate and brick covering as the remainder of the Caney City Hall. The slate and brick would be installed at a later date.
The bid also does not include the finishing treatments inside the facility, including sheetrock, plumbing, cabinets and placement of fixtures in a bathroom and kitchenette. Those, too, would be handled at a later time, councilors said.
Councilors had questions about Uber’s bid, specifically if a metal finish would conflict with the eventual placement of the slate and bricks on the building’s exterior. Councilors said they wished to have clarification on the bid from the project architect, Heckman and Associates of Independence, when the council meets for its regularly scheduled meeting on Monday, Jan. 21.
Councilors also agreed to amend the city’s 2008 budget in five specific funds: general fund, special highway fund, water fund, water debt reserve fund and solid waste fund.
Those funds will have additional money devoted to them as the 2008 budget year comes to a close. The existing mill levy will not be impacted by the increase of funds because several revenue sources devoted to those funds were higher than previously anticipated.
Those five funds will increase by the following amounts in the 2008 budget:
• General fund: from $1,067,423 to $1,115,000, a difference of about $13,000.
• Special highway fund: from $70,000 to $82,000, a difference of $12,000.
• Water fund: from $492,000 to $505,000, a difference of $13,000.
• Water debt reserve fund: from $72,835 to $88,000, a difference of about $15,165.
• Solid waste fund: from $179,000 to $215,000, a difference of about $36,000.

SYCAMORE — Tuesday was the end of a career for a long-time employee of the U.S. Postal Service in Montgomery County.
Edna “Jo” Mills officially retired as the Sycamore postmaster, ending a career that began 35 years ago in Sycamore.
She joined the U.S. Postal Service as a temporary employee in 1975 and maintained that position until 1980, when she became officer in charge of the Sycamore Post Office. She was appointed postmaster on March 21, 1981.
In her role as a postmaster, Mills has had to adjust to numerous changes. But no change was greater like the time the Sycamore Post Office and a neighboring grocery store caught fire in 1986. The post office — an icon in the Sycamore community — was moved to Mills’ home temporarily until a new post office could be erected. A new building was erected one year later on the site of the former post office . . . and Mills returned to her customary position as postmaster and civil servant.
Mills says she is leaving the Sycamore Post Office in good hands. Her daughter, Janice Vail, will serve as officer in charge until a new postmaster is appointed. Vail, who has been employed with the U.S. Postal Service for 28 years, says the Sycamore Post Office has been a second home of sorts as she was raised in that office and taught the ways of the U.S. Postal Service.
Mills also says she was looking forward to her retirement, which will include ample traveling to visit many family members.
“I plan to do some traveling with my sister,” she said. “I have nine brothers and sisters to go see, so I better get started. And, with all the grandchildren and great-grandchildren, I am sure I will be busy.”
A retirement reception was held in Mills’ honor on Tuesday afternoon in the Sycamore Post Office.

INDEPENDENCE — A female inmate of the Montgomery County Jail has filed a federal lawsuit against Montgomery County claiming that the use of a Taser gun against her in a 2007 incident led to the death of her unborn fetus.
Attorneys for Blanca J. Herrera filed the lawsuit in U.S. District Court in Kansas City, Kan., in October. Herrera is asking $3 million in damages.
According to the complaint filed by Herrera’s attorneys, Herrera contends that corrections officer Nick Bradford fired a Taser gun, which momentarily impairs a person through the use of electrical charges, at her after Herrera and another female inmate got in a fight in the county jail in May 2007. Herrera alleges that she was pregnant at the time of the incident. After corrections officer supervisor Debbie Colander broke up the fight and sent the other inmate to her jail cell, Colander began talking to Herrera about the incident, corrections officer Nick Bradford overrode his supervisor’s line of questioning and told her to “shut the (expletive) up.”
Herrera claims that Bradford, without provacation, fired the Taser gun at her with the projectiles hitting her in the right breast and pubic bone.
After receiving the electrical shocks, Herrera was in need of medical attention, the complaint says. She was denied medical attention for 24 hours, even though she requested to see a nurse or director, according to the complaint.
Herrera further claims that when she was finally given medical attention, the actual medical treatment was not given. As a result she suffered a severe staph infection, and her unborn child was involuntarily aborted as a result of the incident.
She also had to undergo psychological counseling due to her injuries and the loss of the unborn child.
According to the complaint, Bradford allegedly used a Taser gun on another inmate three months prior. That inmate was bound in a restraint chair. The inmate died as a result of the Taser shocks, the complaint further says, adding that Bradford remained on duty following the incident.
Herrera was never provided a grievance form or told how to file an official complaint even though she requested to file one. Instead of allowing Herrera to file the complaint, jail administrator Mario Grant “engaged in behavior to intentionally and maliciously cause distress to Blanca Herrera,” the complaint says. This includes Grant activating the trigger on his own Taser gun when he would pass by Herrera’s cell. The noise of the gun would cause it to buzz and crackle in the air, thereby causing distress to Herrera.
Herrera’s mother brought the incident to the attention of state authorities and the media.
As a retaliatory measure against Herrera, Grant was alleged to have told Herrera that her mother was a “bad girl” and proceeded to make a threat against Blanca Herrera’s mother in the presence of Herrera, the complaint says.
Herrera is suing Montgomery County, the Montgomery County Sheriff’s Department, the Montgomery County Department of Corrections, Sheriff Stan Veach, jail administrator Mario Grant and corrections officer Nick Bradford on the following charges:
• battery by Nick Bradford,
• assault by Mario Grant,
• intentional infliction of emotional distress by Mario Grant,
• negligent hiring by Sheriff Stan Veach, the Department of Corrections, and Montgomery County.
• negligent supervision and entrustment,
• denial of medical needs by the Department of Corrections, Sheriff Veach and Montgomery County,
• use of excessive force by Bradford,
• cruel and unusual punishment by Bradford and Grant,
• negligent training by the Department of Corrections, Sheriff Veach and Montgomery County.
Herrera is seeking a federal jury trial.
Her attorneys are Todd P. Graves, Michael L. Belancio and Ryan A. Kriegshauser of the Kansas City, Mo.,-based law firm of Graves Bartles and Marcus, LLC.
Since that complaint was filed in October, Bradford and Grant have submitted responses to the feeral court. The two men deny most of the allegations, including whether Herrera was actually pregnant at the time of the incident.
Bradford claims that after the altercation between Herrera and the other inmate, he repeatedly asked Herrera to calm her behavior after she became “out of control and posed a danger to herself and others.” He warned her that she would be impaired with a Taser if she refused to control her temper. When she refused, Bradford hit Herrera with the Taser weapon with two electrical shocks, both of which, Bradford claims, were very short and did not have any lasting effects.
Bradford contends he was merely using self defense of himself and other corrections officers and inmates as the reason for using the Taser gun on Herrera.
Bradford also asserts that the use of a Taser gun as “privileged under state law and not done with the requisite intent to injure her.”
In his official response to Herrera’s complaint, Grant also denies the allegations brought against him by Herrera.
As in all cases, a person is presumed innocent until proven guilty by a jury of peers or an admission of guilt.

The U.S. Supreme Court will hear arguments on Jan. 21, 2009, in a legal case that originated in Montgomery County.
For the nation’s highest court to agree to hear a locally-originated case is extremely rare as the justices accept only one-tenth of 1 percent of all cases that are forwarded to the Supreme Court for consideration.
The case — State of Kansas vs. Donnie Ray Ventris — will focus on the question of whether information gathered by a confidential informant after a complaint has been filed against an accused person can be admitted into court.
Here are the basic facts of the case . . .
On Jan. 7, 2004, Ernest Hicks was shot and killed allegedly by Donnie Ray Ventris at the Hicks’ home near Dearing. Ventris’ girlfriend Rhonda Theel was in the home when Ventris was shot a total of three times during two different intervals.
Ventris and Theel were arrested and charged with several crimes. Theel eventually entered a plea bargain in exchange for her testimony against Ventris. She pleaded guilty to aggravated robbery and aiding a felon.
Ventris’ former cellmate, Johnny Doser, was used by the Montgomery County prosecutor as a confidential informant. Doser shared a jail cell with Ventris, where he obtained information that was used against Ventris in a jury trial. In exchange for being a confidential informant, Doser was released from jail on probation.
Ventris’ attorneys objected to the use of Doser’s testimony in the trial, saying that Montgomery County’s use of a confidential informant violated Ventris’ constitutional right to counsel. Montgomery County prosecutors conceded the violation but agreed that the testimony could be used for impeachment purposes in the trial. The trial court allowed Doser to testify.
Ventris was eventually convicted of aggravated burglary and aggravated robbery but acquitted of felony murder and misdemeanor theft. He was sentenced to 247 months for aggravated robbery and 34 months for aggravated burglary.
The Kansas Court of Appeals affirmed Ventris’ convictions and sentences. However, the Kansas Supreme Court later heard the case on appeal and determined in February 2008 that Montgomery County prosecutors were wrong in planting the confidential informant in Ventris’ jail cell after Ventris had been charged with the crimes. Ventris’ conviction was overturned by the state supreme court and remanded for a new trial before the Kansas Attorney General’s Office stepped in to seek a clarification on the law. The Attorney General wrote a writ of certiorari to the U.S. Supreme Court asking the high court to make a determination in the discrepancy of case law dealing with confidential informants. The nine justices of the U.S. Supreme Court agreed earlier in the fall to hear the Montgomery County case next January.
William Cullins, who is now a district court judge in Montgomery County, was the prosecuting attorney in the case. He was asked by the Kansas Attorney General’s Office to be an observer in the state’s presentation of oral arguments in the U.S. Supreme Court on Jan. 21. Cullins will attend the hearing along with his wife, Melinda.
A ruling by the U.S. Supreme Court could be handed down by mid-summer 2009.
