Funeral services were held Tuesday, Oct. 28, at Penwell-Gabel Ford-Wulf-Bruns Funeral Home, 2405 Woodland Ave, in Coffeyville. Interment was held at Penwell-Gabel’s Restlawn Memorial Park Cemetery in the Masonic Garden.

Memorial contributions may be given to the First Baptist Church or to the Shriners Hospitals for Children in care of the funeral home.

COFFEYVILLE — Hilton Kunze Davis, 92, a retired Navy captain, of Coffeyville died Sunday, Oct. 26, 2008, at Coffeyville Regional Medical Center.

Funeral services will be held today (Thursday) at 2 p.m., at the Penwell-Gabel Ford-Wulf- Bruns Chapel with J. Collins, pastor of the First United Methodist Church of Coffeyville, officiating. Military honors will be held by a detachment from the United States Navy.

Following the service, cremation will take place and inurnment will take place at a later time at the Dallas-Ft. Worth National Cemetery.

The family has suggested memorial remembrances to the First United Methodist Church of Coffeyville and remembrances will be received at the funeral home.

Friends may call at the funeral home until 9 p.m. tonight (Thursday). The family will receive friends at the funeral home from 6 p.m. until 8 p.m. tonight.

Fire of unknown origin consumed a pair of downtown Independence businesses prior to the start of the Neewollah Doo Dah Parade Thursday evening (Oct. 23). 

At about 5:50 p.m., smoke and flames billowed from the Independence News and Wagon Wheel Tavern located on West Main Street, just one block off the parade route.  

Downtown Independence was filled with several thousand spectators awaiting the start of the parade at 6 p.m., and firefighters and police officers had to deal with throngs of people as they dealt with the fire and traffic control. 

The newspaper, which was heavily damaged by fire more than 10 years ago, and the tavern appear to be heavily damaged. Because of the brisk winds blowing Thursday evening, smoke from the fire traveled throughout the downtown business district, shrouding the parade entries and numerous spectators with smoke and soot.  

Firefighters from Independence Fire Department and Montgomery County Rural Fire Department extinguished the blaze some 30 minutes after arriving on the scene. Emergency officials in Independence could not be contacted for further information Thursday night.

CHERRYVALE — Members of the USD 447-Cherryvale Board of Education on Wednesday (Oct. 22) issued a resolution that distances the board from comments made by board president Lance Carter.

At issue where comments Carter made in a letter to the editor printed in a Septemer edition of the Independence Daily Reporter. In that letter, Carter expressed concerns and disappointment in the four school board members who voted in favor of a recent proposal to allow Cherryvale High School to be the subject of reality-based program on a cable television network. Carter was one of three board members to vote against the proposal.

At the school board’s Oct. 13 meeting, board member Tina Cunningham, who voted in favor of the reality TV issue, expressed appreciation to board members Gina Booe and Sharon Wadman, who joined Carter in voting against the reality TV proposal, for not issuing opinions about the matter in the form of a letter to the editor.

Carter, who operates a privately-owned website in which he provides commenetary about various school board matters, responded to Cunningham’s comments last weekend. His comments said, “I know she (Tina) thought I might respond right then and there and hoped to see me cringe. I didn’t cringe, and I didn’t respond.

“Tina gets a free pass this week on this site, but not the weeks to come.”

At the board’s special meeting on Wednesday, Cunningham expressed frustration and disappointment in how Carter has handled his disagreements with fellow school board members.

“I don’t condemn anybody for voting differently than I do,” said Cunningham directly to Carter. “I respect the democracy of this board. If you cannot do that, you need to reconsider your place on this board and reconsider your leadership on this board.”

Cunningham also asked Carter to remove her name and references to her, including her telephone number and e-mail address, from his privately-owned website. Carter has the telephone numbers and e-mail addresses of all school board members posted on his website.

Carter did not respond to Cunningham’s request to remove material from his website.

Cunningham then presented a draft resolution that says any comments made by Carter do not speak for the rest of the board or the school district. While Cunningham admitted that the resolution will not muzzle Carter from expressing his views, the resolution itself will tell people that Carter’s opinions should not be construed as the same views of the rest of the school board.

Board members had numerous questions about the resolution and its intent.

“I’m not sure how it protects us from Lance whenever he puts something in the newspaper,” said board member Bruce Thornton.

Cunningham said the resolution will show other people that the board does not endorse the opinions of Carter in his letters to the editor or website.

Five members of the board then voted to adopt the resolution. Voting in favor of it were board members Tina Cunningham, Bruce Thornton, Cody Smith, Michelle Loganbill and Gina Booe. Board member Sharon Wadman voted against the measure. Carter abatained from voting, which is considered a “no” vote.

During the board’s discussions on Thursday night, some board members expressed frustration with the lack of unity on the school board in recent months.

Said board member Gina Booe. “Once we leave a meeting, we don’t carry our disagreemnts outside the door of this building. We need to get back to being a cohesive group. We need to agree to disagree and act with integrity . . . and remember that we all live in the same community and that we strive to do the best for our kids.”

Board member Michelle Loganbill said that in recent years, she has felt the board slip away from its vision and focus to provide quality education for kids.

“I think, for lack of a better term, I’m seeing a ‘power trip’ maybe,” she said. “I feel like we’ve lost our focus. I think there is a lot more tension now than there has been in the past.”

Board member Bruce Thornton said he was disappointed in how Carter handled his most recent disagreements with board members.

Thornton said that following the board’s recent decision to allow Cherryvale High School to be the feature of the cable TV show, the board president should have moved on with other matters instead of criticizing the rest of the board in the form of a letter to the editor.

“I have to admit that I was disappointed that you, more or less, put us down for it,” Thornton told Carter of his comments made in that letter to the editor. “I am disappointed that we feel like we have to go to the newspapers. It’s not a big deal for us to disagree with people. But, when I came on this board, I was told by you Lance that we would not fight people with ink. I have to admit that what you did disappointed me.”

In a final question issued to Carter, board member Michelle Loganbill asked Carter if he thought what he said about his fellow board members in the letter to the editor and about Cunningham on his website was “worth it.”

Carter responded by saying, “It’s my First Amendment right.”

Prior to the board’s discussion about Carter’s recent opinions, Carter himself raised issues with the board’s handling of an email last July. Prior to the board’s July meeting, the Montgomery County Chronicle received a copy of an e-mail that Carter had sent to all board members asking that he would be interested in being re-elected as board president for a one-year term. Chronicle editor Andy Taylor questioned the legality of issuing such requests outside an official meeting.

At Wednesday’s special meeting, Carter asked each board member if he or she was the one who leaked that e-mail to the Montgomery County Chronicle. All board members said they did not leak the information.

“Then someone around this table is lying,” Carter said. “Someone around this table had to provide a venue for Mr. Taylor to get this e-mail. I believed I’m owed the identity of who did that.”

Thornton responded by saying, “I guess I don’t know what you (Lance) are getting out of this. What good does it do?”
Carter then said he would not respond to any questions directed to him by the board for the remainder of the meeting.

Whereas these statements do not reflect the opinion of the Board of Education of USD 447 or its other members; and

Whereas the Board of Education of USD 447 has not authorized Lance A. Carter to speak on behalf of the Board of Education or other members in their individual capacity on these issues or any future issues;

Now therefore, the Board of Education specifically disclaims the statements made by Lance A. Carter regarding all board decisions and board relationships.

ORDINANCE No. 08-4569

AN ORDINANCE AMENDING THE REGULATION OF SIDEWALKS AND ALLEYS IN THE CITY OF CHERRYVALE, KANSAS.
BE IT ORDAINED by the Governing Body of the City of Cherryvale, Kansas: 5-822. SIDEWALKS AND ALLEYS, LIMITATION OR OBSTRUCTION OF USE.
(a) It is unlawful for any person owning, occupying or having control of any premises, to place or permit upon the sidewalk, curb ramp or the half of the street next to such premises:
1. Any broken ware, glass, filth, rubbish, refuse matter, ice, water, mud, garbage, ashes, aluminum cans or other substances;
2. Any vehicle, lumber, wood, boxes, fencing, building material, dead trees, tree stumps, merchandise, or other thing that obstructs the public street, curb ramp or sidewalk or any part thereof, or the free use and enjoyment thereof, or the free passage over and upon the same, or any part thereof.
(b) The following shall be exemptions to section (a):
1. The obstruction or limitation of use of the sidewalk is in conjunction with a bona fide sidewalk sale or business promotion, and the business has obtained a permit from the City Clerk for a limited time event not to exceed 48 hours, or
2. A business located in an area zoned for business may display new merchandise in an aesthetically pleasing manner on no more than 25% of the sidewalk positioned closest to the building in which the business operates; or
3. The obstruction or limitation of use of the alley or sidewalk is done in conjunction with repair, maintenance or construction of utility services; or
4. The obstruction or limitation of use of the alley or sidewalk is done in conjunction with the repair, maintenance or construction of improvements upon adjoining property; and
5. If item three or four applies, the obstruction or limitation shall not exist for a time period exceeding seven consecutive days, unless a greater time period is permitted in writing by the City Building Inspector;
6. If item three or four applies, the obstruction or limitation shall be marked with appropriate barricades or warning devises.
(c) Nothing in this ordinance shall limit the authority of the Chief of the Fire Department, which authority is hereby granted, to demand and order immediate cessation of any limitation or obstruction which is determined to be a threat or hindrance to the ability of the fire department to respond to an emergency.
(d) Violation of this ordinance shall carry a fine of $100. Each day any violation of this ordinance continues shall constitute a separate offense.
REPEALED. All ordinances in conflict herewith are hereby repealed.
EFFECTIVE DATE. This ordinance shall be in full force and effect upon its publication in the official city newspaper.

CHARTER ORDINANCE No. 08-22

A CHARTER ORDINANCE OF THE CITY OF CHERRYVALE, KANSAS, EXEMPTING THE CITY OF CHERRYVALE FROM PROVISIONS KSA 14-201 and 14-205 AND PROVIDING SUBSTITUTES AND ADDITIONAL PROVISIONS ON THE SAME SUBJECT.
Be it Ordained by the Governing Body of the City of Cherryvale, Kansas:
Section 1. The City of Cherryvale, Kansas, a city organized under the laws of the State of Kansas as a city of the second class, by virtue of its home rule power vested in it by Article 12, Section 5 of the Constitution of the State of Kansas, hereby elects to exempt and does exempt itself from KSA 14-201 as amended by Chapter 163 of the 2008 Kansas Session Laws and 14-205 which are not uniformly applicable to all cities as the legislature of the State of Kansas has made special statuary provision applying to certain classes of cities in Statues of the State of Kansas. This exemption applies to KSA 14-201 and 14-205 as it now exists or is hereafter amended.
Section 2, substitution for K.S.A. 14-201. (a) There shall be an election on the first Tuesday in April 2009, and every four years afterward for Ward 1 Position 1 Council Member and Ward 2 Position 1 Council Member who shall hold office until a successor is elected and qualified, and
(b) There shall be an election on the first Tuesday in April 2011, and every four years afterward for Mayor, Ward 1 Position 2 Council Member, and Ward 2 Position 2 Council Member who shall hold office until a successor is elected and qualified, and
(c) The city council shall develop and implement policies and procedures by regular ordinance for employing, evaluating, and retaining or not retaining in employment all non-elected and appointed personnel, including those enumerated in K.S.A. 14-201 and a non-elected City Treasurer.
(d) Further the City of Cherryvale shall also provide by regular ordinance procedures for any appointment to any board, commission, advisory group or other body made by the Mayor of Cherryvale.
Section 3, substitution for K.S.A. 14-205. (a) All officers elected shall be qualified electors of the City of Cherryvale.
(b) The City Council shall develop and implement policies and procedures by regular ordinance for employing, evaluating, and retaining or not retaining in employment all non-elected and appointed personnel.
Section 4. Section 4 of Charter Ordinance 96-20 is hereby repealed.
Section 5. This ordinance shall be published once a week for two (2) consecutive weeks in the official newspaper of the City of Cherryvale.
Section 6. This is a Charter Ordinance and shall take effect sixty one (61) days after its final publication, unless a sufficient petition for referendum is filled and a referendum held on this ordinance as provided in Article 12, Section 5, subdivision (c) 3 of the Constitution of Kansas, in which case this ordinance shall become effective if approved by a majority of electors voting thereon.
Passed and Adopted by the said Governing Body, not less than two-thirds of the members elect voting in favor thereof, the 20th day of October, 2008.

ORDINANCE No. 08-4570

AN ORDINANCE REGULATING CARGO CONTAINERS IN THE CITY OF CHERRYVALE, KANSAS.
BE IT ORDAINED by the Governing Body of the City of Cherryvale, Kansas:
SECTION I. DEFINITION. “Cargo Container” means a standardized, reusable vessel that was:
1. Originally, specifically or formerly designed for or used in the packing, shipping, movement or transportation of freight, articles, goods or commodities, and/or,
2. Designed for or capable of being mounted or moved on a rail car, and/or
3. Designed for or capable of being mounted on a chassis or trailer for movement by tractor trailer, railroad or loaded on a ship. Examples include, but are not limited to: sea cargo containers, railroad boxcars, tractor trailers, and freight trailers.
SECTION II. REQUIREMENTS. The requirements for placing a cargo container onto a private lot are as follows:
1. On sites of less than 2 acres (gross) where the primary use is residential only, one Cargo Container is allowed; not exceeding 320 square feet and the container is only permitted for up to 180 consecutive days, starting from the date of permit issuance.
2. On sites of more than 2 acres (gross) with a legally established primary use, a Cargo Container is allowed if it complies with all other requirements for an accessory building within that zoning area.
3. Cargo Containers must meet setback requirements for accessory structures.
4. The square footage of the Cargo Container shall be added to the allowable combined square footage of all existing and/or proposed accessory structures.
5. Cargo Containers can only be used for storage. Use of the container for
residential or business purposes is not permitted.
6. Cargo Containers may be allowed in commercial and industrial zoned areas I1 and I2 as permitted uses, and B2, B3, B4 as conditional use. Permitted and Conditional uses apply only if there is a legally established primary use on-site and all parking requirements are maintained. Cargo Containers are not permitted on frontages of commercial or industrial zoned property.
7. Cargo Containers may not occupy any required off-street parking spaces.
8. If located adjacent to a building, the cargo container must be painted to match the building’s color.
9. Cargo Containers are allowed in all zones temporarily to store building materials during the construction pursuant to an active building permit. If the building permit is expired, the Cargo Container shall be removed.
10. All current containers fixed to property will be considered legal structures and may remain in place so long as the location and screening are not altered. All trailer designed cargo containers, with wheels and tires in place, must be removed. If an approved cargo container is moved off a residential zoned property containing a residential use, no new container may be moved onto the property.
SECTION III. EFFECTIVE DATE. This ordinance shall take effect and be in force upon its publication in the official city newspaper.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF CANEY, KANSAS:
Section 1. That Chapter I (Administration), Article 4 (Administration) of the Code of Ordinances of the City of Caney, Kansas be and is hereby amended by adding a new Section 1-407, relating to residency requirements for city employees, as follows:
1-407. RESIDENCY REQUIREMENTS FOR CITY EMPLOYEES. As a condition of continued employment, (1) the City Administrator and all emergency-type personnel (Police Chief, Assistance Police Chief, Police Officers and Dispatchers) are required to reside within the boundaries of the city limits of Caney, Kansas, and (2) all key personnel (City Superintendent, City Clerk, Assistant City Clerk Fire Chief, Water Plant Operator, Back-up Water Plant Operator and Sewer Plant Operator) are required to reside within the 879 telephone exchange area. For any newly created position(s), the council shall determine the residency requirement based on the emergency/key/other classification
Section 2. That Section 5-A. 1 of the Personnel Policy Manual be and is hereby repealed in deference to new Section 1-407 of the Code of Ordinances.
Section 3. Except as otherwise amended, all remaining articles and provisions of Chapter I of the Code of Ordinances shall remain in full force and effect.
Section 4. This Ordinance shall be effective upon publication in the official city newspaper.

In recent sports events at Caney Valley Jr.-Sr. High School and Cherryvale Middle-High School:

• Caney Valley Jr. High School won its second consecutive Tri-Valley League football title after defeating the Humboldt Cubs, 42-6, on Oct. 16. Caney Valley finshed the season with a 7-0 record, matching last season’s record.

• The Caney Valley High School cross country team won the Tri-Valley League title at the Burlington Invitational Meet on on Oct. 16.

• Cherryvale High School’s varsity football team clobbered the Erie Red Devils, 54-0, on Oct. 17 to take a 1-0 stand in the class 3A, district 2 playoffs. The Chargers are now 7-0 overall and will travel to Frontenac for the second game of the three-game district playoffs on Friday, Oct. 24.

• Caney Valley High School’s varsity football team will host the undefeated and state-ranked Riverton Rams on Friday, Oct. 24. The game will pit two teams that are now 1-0 in the class 3A, district playoffs. Caney Valley defeated Baxter Springs, 32-14, on Oct. 17 while Riverton defeated the Galena Bulldogs, 42-6, on that same night.

• McKenzie Rolls and Lindsey Testerman of Caney Valley High School girls’ golf team competed in the class 4A state golf tournament on Oct. 20. The two girls did not have scores within the medal threshold.

• Named to the All-Southeat Kansas League girls’ golf circuit for 2008 were Caney Valley sophomore Lyndsay Roper, junior Paige Chaffin and senior Cassie Cunningham. Named as honorable mention players were Lindsay Testerman and McKenzie Rolls.

• Cherryvale High School’s varsity volleyball team will play in the class 3A sub-state volleyball tournament in Frontenac, Kan., on Saturday, Oct. 25. The Chargers, seeded fifth with a 11-19 record, will play Fredonia, the fourth seed with a 15-16 record, at 2 p.m.

• Caney Valley High School will host the class 4A sub-state tournament on Saturday, Oct. 25. Caney Valley is seeded seventh with a 4-25 record and will play Circle-Towanda, the second seed with a 26-11 record at 2 p.m.

Brooke Rollison named Queen Neelah the 67th

INDEPENDENCE — Brooke Rollison of Independence was crowned Queen Neelah the 67th during coronation ceremonies Tuesday night coinciding with the annual Neewollah festival in Independence.

Earning the title of first runner up was Kelsie Meier of Independence. Marylynn Craig, also of Independence, was named second runner-up.

Nine other queen candidates were bestowed honors at the coronation ceremony. They include:

CHERRYVALE — City councilors on Monday adopted new laws regulating the use of cargo containers inside the city limits and also prohibiting obstructions on city sidewalks.

Based on a recommendation from the Cherryvale Planning and Zoning Commission, councilors voted unanimously to adopt the ordinance that will allow cargo containers — large shipping containers that generally carry goods from China — to be placed on local properties provided they are used for the temporary holding of construction materials or temporary storage.

Among the other provisions in the new ordinance:

• cargo containers not exceeding 320 square feet will be allowed on residential properties of less than 2 acres for no more than 180 consecutive days.

• cargo containers on properties of 2 acres or more will be allowed provided that they meet all other requirements within those zoned areas.

• cargo containers must meet all setback requirements, shall be used solely for storage, and may not occupy off-street parking spaces. If located adjacent to a building, the cargo container must be painted to match the building’s color.

• cargo containers will not be used for residential or commercial purposes.

Trey Cocking, city administrator, said other communities had experienced problems of persons using cargo containers as a residence or commercial building.

Councilors also approved an ordinance that limits the obstruction of city sidewalks.

The ordinance, which was approved on a 4-0 vote, will prohibit the blocking of a sidewalk by vehicles, trash piles, fences, dense vegetation, or construction materials.

Retail businesses will be allowed to place goods on the sidewalks as part of a sidewalk sale or business promotion provided that the goods do not occupy more than 25 percent of the sidewalk positioned closest to the business structure. Businesses may display their goods on the sidewalk “in an aesthetically pleasing manner,” according to the new city ordinance.

Obstruction of sidewalks by vehicles is allowable but only when the sidewalk in the immediate area is involved in the repair, maintenance or replacement of utility services, according to the ordinance.

PARSONS — Caney Valley High School’s debate program earned a first-place sweepstakes trophy at the Parsons Invitational Tournament last Saturday, Oct. 18.

Caney Valley was aided in its championship trophy with four veteran teams earning medals.

The team of Trevor Buster/Bruce Williams won first place among all experienced teams by posting a 7-0 victory. Among those victories was the championship round, where Buster and Williams defeated another Caney Valley team: Casey McCammon/Caleb McIntosh. The McCammon/McIntosh team finished the tournament with a 6-1 record.

In third plae overall was the Caney Valley team of C.J. Brown/Brandon Blagg, which ended the day with a 4-2 record.

The team of Holly Barks/Melanie Davis finished the meet with a seventh-place medal after posting a 3-2 record.

In the novice division, the team of Megan Evans/Luke DeWitt captured first place due to the team’s 5-0 record.

The team of Kurt Lockwood/Cessalie Wood also represented Caney Valley at the tournament.

Caney Valley will prepare to host its own tournament on Saturday, Nov. 8. Local volunteers are needed to serve as judges of the tournament Persons interested in serving as judges should contact Amber Toth, debate instructor, at (620) 879-9220.
