AN ORDINANCE AUTHORIZING THE OPERATION OF MICRO UTILITY TRUCKS AND ALL-TERRAIN VEHICLES ON THE STREETS WITHIN THE CORPORATE LIMITS OF THE CITY  OF CHERRYVALE; PROVIDING FOR RELATED MATTERS INCLUDING PENALTIES FOR  VIOLATION THEREOF.
Be it Ordained by the Governing Body of the City of Cherryvale, Kansas:
Section 1. OPERATION OF MICRO UTILITY TRUCKS; PENALTY.
(a) Micro utility trucks may be operated upon the public highways, streets, roads, and alleys  within the corporate limits of the city.
(b) No micro utility truck shall be operated on any public highway, street, road, or alley unless  such vehicle shall comply with the equipment requirements under the provisions of article 17,  chapter 8 of the Kansas Statutes Annotated.
(c) A violation of this section shall be deemed an ordinance traffic infraction. Upon an entry of a  plea of guilty or no contest or upon being convicted of such violation, the penalty imposed shall  be in accordance with Section 201, 2007 Standard Traffic Ordinance, and amendments thereto,  or such other similar provision as the City may then have in effect.
Section 2. SAME; DEFINITIONS.  Micro utility truck means any motor vehicle which is not less than 48 inches in width, has an overall length, including the bumper, of not more than 144 inches, has an unladen weight,  including fuel and fluids, of more than 1,500 pounds, can exceed 40 miles per hour as originally  manufactured, and is manufactured with a metal cab.
Section 3.  SAME: VALID DRIVER’S LICENSE REQUIRED; PENALTY.  No person shall  operate a micro utility truck on any public highway, street, road or alley within the corporate  limits of the city unless such person has a valid driver’s license.  Violation of this section is  punishable by a fine of not more than $1,000 or by imprisonment for not more than six months  or by both such fine and imprisonment.
Section 4.  OPERATION OF ALL-TERRAIN VEHICLES.
(a) All-terrain vehicles may be  operated upon the public highways, streets, roads and alleys within the corporate limits of the  city.
(b) “All-terrain vehicle” means any motorized non-highway vehicle 48 inches or less in  width, having a dry weight of 1,000 pounds or less, traveling on three or more low pressure tires, and having a seat to be straddled by the operator.  As used in this subsection, “low  pressure tire” means any pneumatic tire six inches or more in width, designed for use on wheels with rim diameter of 12 inches or less, and utilizing an operating pressure of 10 pounds per  square inch or less as recommended by the vehicle manufacturer.
(c)  No all-terrain vehicle shall be operated on any public highway, street, road or alley  between sunset and sunrise unless equipped with lights as required for motorcycles.
(d)  Every person operating an all-terrain vehicle on the public highways, streets, roads  and alleys of the city shall be subject to all of the duties applicable to a driver of a vehicle  imposed by law.
(e)  A person operating an all-terrain vehicle shall ride only upon the permanent and  regular seat attached thereto, and such operator shall not carry any other person nor shall any other person ride on a all-terrain vehicle, unless such all-terrain vehicle is designed to carry more than one (1) person, in which event a passenger may ride upon the permanent and  regular seat if designed for two (2) persons, or upon another seat firmly attached to the allterrain vehicle at the rear or side of the operator.
(f)  A person shall ride upon an all-terrain vehicle only while sitting astride the seat,  facing forward, with one leg on each side of the all-terrain vehicle.
(g) No person shall operate an all-terrain vehicle while carrying any package, bundle, or  other article which prevents such person from keeping both hands on the handlebars.
(h) No operator shall carry any person, nor shall any person ride, in a position that will  interfere with the operation or control of the all-terrain vehicle or the view of the operator.
Section 4.  SAME; ROADWAYS LANED FOR TRAFFIC.
(a) All all-terrain vehicles are entitled to full use of a lane, and no motor vehicle shall be driven in such a manner as to deprive any all-terrain vehicle of the full use of a lane. This subsection shall not apply to all-terrain vehicles  operated two (2) abreast in a single lane.
(b) The operator of a all-terrain vehicle shall not overtake and pass in the same lane  occupied by the vehicle being overtaken.
(c) No person shall operate a all-terrain vehicle between lanes of traffic or between  adjacent lines or rows of vehicles.
(d) All-terrain vehicles shall not be operated more than two (2) abreast in a single lane.
(e) Subsections (b) and (c) shall not apply to police officers in the performance of their  official duties.
Section 5.  SAME; CLINGING TO OTHER VEHICLES PROHIBITED. No person riding upon an all-terrain vehicle shall attach himself, herself or the all-terrain vehicle to any other vehicle on a  roadway.
Section 6.  SAME; EQUIPMENT ON ALL-TERRAIN VEHICLES FOR PASSENGERS. Any allterrain vehicle carrying a passenger shall be equipped with a seat and footrests for such  passenger.
Section 7.  OPERATION OF ALL-TERRAIN VEHICLES; EQUIPMENT REQUIRED FOR  OPERATORS AND RIDERS.
(a) No person under the age of 18 years shall operate or ride upon an all-terrain vehicle unless wearing a helmet which complies with minimum guidelines  established by the National Highway Traffic Safety Administration pursuant to the National Traffic and Motor Vehicle Safety Act of 1966 for helmets designed for use by motorcyclists and other  motor vehicle users.
(b) No person shall operate an all-terrain vehicle unless such person is wearing an eyeprotective device which shall consist of protective glasses, goggles or transparent face shields  which are shatter proof and impact resistant, except when the all-terrain vehicle is equipped with a windscreen which has a minimum height of 10 inches measured from the center of the  handlebars.
Section 8.  SAME; PENALTIES.  A violation of any provision in sections 3 through 7 shall be deemed an ordinance traffic infraction.  Upon an entry of a plea of guilty or no contest or upon  being convicted of such violation, the penalty imposed shall be in accordance with Section 201,  2007 Standard Traffic Ordinance, as amended, or such other similar provision as the city may  then have in effect.
Section 9.  SAME: VALID DRIVER’S LICENSE REQUIRED; PENALTY.  No person shall  operate an all-terrain vehicle on any public highway, street, road or alley within the corporate  limits of the city unless such person has a valid driver’s license.  Violation of this section is  punishable by a fine of not more than $1,000 or by imprisonment for not more than six months or by both such fine and imprisonment.
Section 10. LIABILITY INSURANCE; All insurance requirements of Section 200 of the Standard Traffic Ordinance shall apply to both micro utility trucks and ATVS, and shall carry the same  penalty.
REPEAL.  All other ordinances in conflict herewith are hereby repealed.
EFFECTIVE DATE.  This ordinance shall take effect and be in force upon its publication in the official city newspaper.

PUBLIC NOTICE

Bee Creek Watershed Joint District No 15 has filed an application for permit to appropriate water for beneficial use, identified as File No. 47.092, with the Division of Water Resources, Kansas Department of Agriculture. Bee Creek Watershed Joint District No. 15 proposes to appropriate such unappropriated surface water as may be available in the drainage basin of the Caney River, to be diverted and stored by means of eight (8) existing watershed dams and reservoirs with a total surface area of 228.5 acres, located in both Montgomery County and Chautauqua County, Kansas.  The total quantity of water requested is 509.2 acre-feet per calendar year for sediment control use. The requested quantity is equivalent to three (3) times the net annual evaporation from the surface area of the reservoirs.
Any interested party is invited to submit written comments regarding this matter to the office of the Chief Engineer on or before August 15, 2008.  Persons submitting comments should specifically indicate their interest in the application in a clear and concise manner.

BID NOTICE
EAST AND WEST SIDE DISTRIBUTION SYSTEM IMPROVEMENTS
FOR P.W.W.S.D. NO. 4, KANSAS
KPWSLF PROJECT #2505

Sealed proposals will be received by the District Manager at the P.W.W.S.D. No. 4, Water Treatment Plant, 18077 Douglas, P.O. Box 6, Cherryvale, KS, 67335, until 2:00 p.m. on Tuesday, August 5, 2008 at which time proposals for construction of East and West Side Distribution System Improvements, KPWSLF Project 2505 will be opened and read aloud.
The work under this Contract consists of the following approximate quantities:
18,605 feet of 8” and 310 feet of 6” East Waterline and 16,570 feet of 10” West Waterline, the West Booster Pump Station and related appurtenances.
All equipment, material and workmanship must be in accordance with the Plans, Specifications and other Contract Documents in the Project Manual on file with the District Manager, P.W.W.S.D. No. 4, and in the office of the Consulting Engineers, LARKIN GROUP, INC., 9200 Ward Parkway, Suite 400, Kansas City, Missouri 64114.
Copies of the contract documents necessary for bidding may be obtained from the Consulting Engineer.
Non-Refundable Payment for Plans and Project Manual:  $55.00 for each set of Plans and Project Manual.
A bid bond or certified check on a reputable bank in an amount equal to five (5%) percent of the total amount of each section bid must accompany each Proposal.
No bidder may withdraw his bid for a period of sixty (60) days after date of opening of bids.
The Owner reserves the right to reject any or all bids and to waive informalities therein, to determine which is the lowest and best bid, to accept, at its option, any of the alternates, and to approve the bond.
“Bidders on this work, including sub-contractors or vendors, will be required to comply with the Kansas Act Against Discrimination (K.S.A. 44-1001 et. seq.) and the Kansas Age Discrimination in Employment Act (K.S.A. 44-1111 et. seq.)”.
Bidders shall submit the KPWSLF Disadvantaged Business Enterprise Information Sheet, Section 31.36 (e) of the March 11, 1988 EPA Procurement Regulations, Procedures for Implementing of MBE/WBE, and Minority and Women’s Disadvantaged Business Enterprise Utilization Worksheet as part of their bids.
Successful bidder must comply with the NPDES General Permit Coverage for Discharges of Stormwater Runoff from Construction Activities.
