CANEY — Two Caney residents were arrested late Tuesday night, July 8, after a marijuana growing operation was found in a local home.
Rick Pell, police chief, said Tim and Teresa Ingram were arrested in their home at 110 E. Third following the execution of a search warrant. Pell said an anonymous tip from a citizen alerted the Caney Police Department to the marijuana cultivation operation in the Ingrams’ attic.
Pell described the operation as “sophisticated” because of the volume and arrangement of equipment used in the growth of marijuana plants. The equipment included a water circulation system that recycled the water used in the plants’ growth. Various fertilizers and other plant growth-related chemicals were found in the attic as were several growing lights that were set up on a timing device to provide the optimum amount of light.
Two rooms in the attic were used in the operation. One room started as an incubator for the marijuana seeds while a second room contained more mature plants. Dried marijuana leaves were found throughout the attic and throughout the house, including in the kitchen and freezer.
Several hand-written notes on the wall of the attic revealed some of the ratios of chemicals used in the cloning and/or fertilization of the marijuana plants, Pell said.
Other drug paraphernalia was found in a detached garage, Pell said.
The street value of the confiscated marijuana was estimated between $150,000 and $200,000, Pell said.
“This was definitely a large-scale operation – very sophisticated,” he said.
Upon entering the home, police discovered Tim Ingram in his bedroom reaching for a gun in a dresser. Law enforcement officers were able to nab Ingram before he was able to clutch the weapon in a clothes drawer.
Two children in the home were taken into protective custody following the Ingrams’ arrests, and Pell said the Ingrams would likely face several charges, including child endangerment and possession of marijuana with intent to sell. Formal charges are expected to be issued against the couple later in the week.
Pell said police officers and other law enforcement officers involved in the arrests and investigation were troubled to find marijuana pipes and marijuana leaves sitting next to various children’s articles, including markers and coloring books, on a coffee table in the Ingram living room.
“I think that pretty tells the story of this family,” he said.
Members of the Coffeyville Police Department and the Montgomery County Sheriff’s Department assisted the Caney Police Department in the arrest of the Ingrams as well as the follow-up investigation.
“This is the second major drug bust we’ve had in Caney in as many weeks,” said Pell, noting that a methamphetamine laboratory was discovered in a South McGee Street home two weeks ago.
Pell urged citizens to contact the Caney Police Department concerning suspected drug activity in their neighborhood.

OPERATION OF MICRO UTILITY TRUCKS AND ALL-TERRAIN VEHICLES ON THE STREETS
ORDINANCE NO. 08-4562
AN ORDINANCE AUTHORIZING THE OPERATION OF MICRO UTILITY TRUCKS AND ALL-TERRAIN VEHICLES ON THE STREETS WITHIN THE CORPORATE LIMITS OF THE CITY OF CHERRYVALE; PROVIDING FOR RELATED MATTERS INCLUDING PENALTIES FOR VIOLATION THEREOF.
Be it Ordained by the Governing Body of the City of Cherryvale, Kansas:
Section 1. OPERATION OF MICRO UTILITY TRUCKS; PENALTY.
(a) Micro utility trucks may be operated upon the public highways, streets, roads, and alleys within the corporate limits of the city.
(b) No micro utility truck shall be operated on any public highway, street, road, or alley unless such vehicle shall comply with the equipment requirements under the provisions of article 17, chapter 8 of the Kansas Statutes Annotated.
(c) A violation of this section shall be deemed an ordinance traffic infraction. Upon an entry of a plea of guilty or no contest or upon being convicted of such violation, the penalty imposed shall be in accordance with Section 201, 2007 Standard Traffic Ordinance, and amendments thereto, or such other similar provision as the City may then have in effect.
Section 2. SAME; DEFINITIONS. Micro utility truck means any motor vehicle which is not less than 48 inches in width, has an overall length, including the bumper, of not more than 144 inches, has an unladen weight, including fuel and fluids, of more than 1,500 pounds, can exceed 40 miles per hour as originally manufactured, and is manufactured with a metal cab.
Section 3. SAME: VALID DRIVER’S LICENSE REQUIRED; PENALTY. No person shall operate a micro utility truck on any public highway, street, road or alley within the corporate limits of the city unless such person has a valid driver’s license. Violation of this section is punishable by a fine of not more than $1,000 or by imprisonment for not more than six months or by both such fine and imprisonment.
Section 4. OPERATION OF ALL-TERRAIN VEHICLES.
(a) All-terrain vehicles may be operated upon the public highways, streets, roads and alleys within the corporate limits of the city.
(b) “All-terrain vehicle” means any motorized non-highway vehicle 48 inches or less in width, having a dry weight of 1,000 pounds or less, traveling on three or more low pressure tires, and having a seat to be straddled by the operator. As used in this subsection, “low pressure tire” means any pneumatic tire six inches or more in width, designed for use on wheels with rim diameter of 12 inches or less, and utilizing an operating pressure of 10 pounds per square inch or less as recommended by the vehicle manufacturer.
(c) No all-terrain vehicle shall be operated on any public highway, street, road or alley between sunset and sunrise unless equipped with lights as required for motorcycles.
(d) Every person operating an all-terrain vehicle on the public highways, streets, roads and alleys of the city shall be subject to all of the duties applicable to a driver of a vehicle imposed by law.
(e) A person operating an all-terrain vehicle shall ride only upon the permanent and regular seat attached thereto, and such operator shall not carry any other person nor shall any other person ride on a all-terrain vehicle, unless such all-terrain vehicle is designed to carry more than one (1) person, in which event a passenger may ride upon the permanent and regular seat if designed for two (2) persons, or upon another seat firmly attached to the allterrain vehicle at the rear or side of the operator.
(f) A person shall ride upon an all-terrain vehicle only while sitting astride the seat, facing forward, with one leg on each side of the all-terrain vehicle.
(g) No person shall operate an all-terrain vehicle while carrying any package, bundle, or other article which prevents such person from keeping both hands on the handlebars.
(h) No operator shall carry any person, nor shall any person ride, in a position that will interfere with the operation or control of the all-terrain vehicle or the view of the operator.
Section 4. SAME; ROADWAYS LANED FOR TRAFFIC.
(a) All all-terrain vehicles are entitled to full use of a lane, and no motor vehicle shall be driven in such a manner as to deprive any all-terrain vehicle of the full use of a lane. This subsection shall not apply to all-terrain vehicles operated two (2) abreast in a single lane.
(b) The operator of a all-terrain vehicle shall not overtake and pass in the same lane occupied by the vehicle being overtaken.
(c) No person shall operate a all-terrain vehicle between lanes of traffic or between adjacent lines or rows of vehicles.
(d) All-terrain vehicles shall not be operated more than two (2) abreast in a single lane.
(e) Subsections (b) and (c) shall not apply to police officers in the performance of their official duties.
Section 5. SAME; CLINGING TO OTHER VEHICLES PROHIBITED. No person riding upon an all-terrain vehicle shall attach himself, herself or the all-terrain vehicle to any other vehicle on a roadway.
Section 6. SAME; EQUIPMENT ON ALL-TERRAIN VEHICLES FOR PASSENGERS. Any allterrain vehicle carrying a passenger shall be equipped with a seat and footrests for such passenger.
Section 7. OPERATION OF ALL-TERRAIN VEHICLES; EQUIPMENT REQUIRED FOR OPERATORS AND RIDERS.
(a) No person under the age of 18 years shall operate or ride upon an all-terrain vehicle unless wearing a helmet which complies with minimum guidelines established by the National Highway Traffic Safety Administration pursuant to the National Traffic and Motor Vehicle Safety Act of 1966 for helmets designed for use by motorcyclists and other motor vehicle users.
(b) No person shall operate an all-terrain vehicle unless such person is wearing an eyeprotective device which shall consist of protective glasses, goggles or transparent face shields which are shatter proof and impact resistant, except when the all-terrain vehicle is equipped with a windscreen which has a minimum height of 10 inches measured from the center of the handlebars.
Section 8. SAME; PENALTIES. A violation of any provision in sections 3 through 7 shall be deemed an ordinance traffic infraction. Upon an entry of a plea of guilty or no contest or upon being convicted of such violation, the penalty imposed shall be in accordance with Section 201, 2007 Standard Traffic Ordinance, as amended, or such other similar provision as the city may then have in effect.

No person shall operate an all-terrain vehicle on any public highway, street, road or alley within the corporate limits of the city unless such person has a valid driver’s license. Section 10. LIABILITY INSURANCE; All insurance requirements of Section 200 of the Standard Traffic Ordinance shall apply to both micro utility trucks and ATVS, and shall carry the same penalty.
REPEAL. All other ordinances in conflict herewith are hereby repealed.
EFFECTIVE DATE. This ordinance shall take effect and be in force upon its publication in the official city newspaper.

PUBLIC NOTICE
Bee Creek Watershed Joint District No 15 has filed an application for permit to appropriate water for beneficial use, identified as File No. 47.092, with the Division of Water Resources, Kansas Department of Agriculture. Bee Creek Watershed Joint District No. 15 proposes to appropriate such unappropriated surface water as may be available in the drainage basin of the Caney River, to be diverted and stored by means of eight (8) existing watershed dams and reservoirs with a total surface area of 228.5 acres, located in both Montgomery County and Chautauqua County, Kansas. The total quantity of water requested is 509.2 acre-feet per calendar year for sediment control use. The requested quantity is equivalent to three (3) times the net annual evaporation from the surface area of the reservoirs.
Any interested party is invited to submit written comments regarding this matter to the office of the Chief Engineer on or before August 15, 2008. Persons submitting comments should specifically indicate their interest in the application in a clear and concise manner.

Shall Montgomery County, Kansas, be authorized to: (a) impose a special one-fourth percent (0.25%) retailers’ sales tax (the “Sales Tax”) for the purpose of financing the cost of constructing, furnishing and equipping an addition to the existing Montgomery County detention facility; and costs appurtenant thereto (the “Project”), collection of such Sales Tax to commence on January 1, 2009, or as soon thereafter as permitted by law, and to terminate upon the payment of all costs incurred in the financing of the Project (including the retirement of any revenue bonds issued and payable from such Sales Tax); and (b) issue sales tax revenue bonds to pay the costs of the Project and associated reserves and financing costs; all pursuant to the authority of K.S.A. 12-187 et seq., as amended?

EAST AND WEST SIDE DISTRIBUTION SYSTEM IMPROVEMENTS
FOR P.W.W.S.D. NO. 4, KANSAS

Sealed proposals will be received by the District Manager at the P.W.W.S.D. No. 4, Water Treatment Plant, 18077 Douglas, P.O. Box 6, Cherryvale, KS, 67335, until 2:00 p.m. on Tuesday, August 5, 2008 at which time proposals for construction of East and West Side Distribution System Improvements, KPWSLF Project 2505 will be opened and read aloud.
The work under this Contract consists of the following approximate quantities:
18,605 feet of 8” and 310 feet of 6” East Waterline and 16,570 feet of 10” West Waterline, the West Booster Pump Station and related appurtenances.
All equipment, material and workmanship must be in accordance with the Plans, Specifications and other Contract Documents in the Project Manual on file with the District Manager, P.W.W.S.D. No. 4, and in the office of the Consulting Engineers, LARKIN GROUP, INC., 9200 Ward Parkway, Suite 400, Kansas City, Missouri 64114.
Copies of the contract documents necessary for bidding may be obtained from the Consulting Engineer.
Non-Refundable Payment for Plans and Project Manual: $55.00 for each set of Plans and Project Manual.
A bid bond or certified check on a reputable bank in an amount equal to five (5%) percent of the total amount of each section bid must accompany each Proposal.
No bidder may withdraw his bid for a period of sixty (60) days after date of opening of bids.
The Owner reserves the right to reject any or all bids and to waive informalities therein, to determine which is the lowest and best bid, to accept, at its option, any of the alternates, and to approve the bond.

Whether to continue using private contractors for trash removal in Cherryvale or to shift to a city-provided trash service was discussed at Monday’s Cherryvale City Council meeting.
Councilors were presented with a feasibility study by city administrator Trey Cocking that compared the costs of using private trash contractors versus the implementation of a city-owned trash service. The City of Cherryvale currently has a contract with Dual County Sanitation for its trash service. The contract with Dual County will expire in 2010, however the city can decide this year whether to remain with the final two years of that contract.
The study showed that annual expenses of a city-owned trash service could range from $133,600 to $240,000 per year, depending on the number of city employees used on a trash truck and the condition of a trash truck (new versus pre-owned).
Should the council pursue a city-owned trash service, trash rates would have to likely double in size, meaning residential customers would pay about $15 or $16 per month compared to the $8.50 they now pay for a private hauler.
So what is the incentive for a city-owned trash service? Quality control over trash removal, councilors said.
With a city-provided trash service, issues relating to trash removal can be handled in a more timely fashion than compared to a private hauler, councilors said.
However, the rate structure of a private hauler versus city-owned service also is a primary factor in determining which type of service to use, councilors said.
Regardless of whether the city uses its own service or continues using a private hauler, local trash customers can expect to see some sort of an increase in their rates in the coming years due to rising fuel costs and increased landfill tipping fees, councilors said.
Councilor Kevin Crain said he was concerned about the longevity of the Allied Waste Landfill located south of Cherryvale, which is where Dual County Sanitation disposes of its Cherryvale trash.
“Right now, we’re lucky to have a landfill four miles away,” he said. “But in another five years, or whenever the landfill is full, we may have to take our trash to a landfill 40 miles away. That’ll add to the fuel costs, which means higher trash rates.”
Councilors said they appreciated the feasibility study and would consider the issue when they decide whether to renew the city’s contract with Dual County Sanitation.
In other business transacted at Monday’s Cherryvale City Council meeting, councilors:
• held discussion on the water rates for rural residents who are connected to the city’s water system. After raising water rates in the spring, councilors set August as the deadline to assess a new rate structure for rural residents.
Councilors were given a report detailing the actual cost of providing water services to rural residents. To fairly assess a fee that allows the city to break even with its costs for those rural residents, the city would need to raise water fees to those rural customers by at least 32.11 percent.
Trey Cocking, city administrator, said there were a total of 102 households in rural areas that use city water.
Councilors did not take any action on the proposed rate hike, but Cocking said he submitted the cost analysis to gauge the council’s reaction. He said he would present a formal proposal for a rate hike for rural residents at the council’s next meeting.
• agreed to donate $100 to the Meals on Wheels program in Montgomery County to partially offset the rising cost of fuel for transporting meals to elderly residents.
• held condemnation hearings for five local homes located at 212 S. Wilson, 612 E. Second, 726 E. Third, 322 W. Second and 300 E. Main. Councilors agreed to pursue full condemnation of those properties, which allows the city to raze the structures after Aug. 15.
One of those structures at 322 W. Second has a prospective new owner who intends to renovate the structure. The residence is believed to be the birthplace of television star Vivian Vance, best known for her role of Ethel Mertz on “I Love Lucy.” Ron Davis, fire chief and zoning administrator, did not reveal the name of the prospective home buyer but indicated that the buyer had a vision for renovating the structure soon.
“It’s really beyond repair,” Davis said of the structure.
Councilors agreed to condemn the house but to allow the prospective owner to attend the council’s first meeting in August to provide a detailed plan of action.
Councilors also learned that the residence at 612 E. Second had been demolished last week by the property owner.

Logan Carnes did not bring home a belt buckle or saddle or trophy from a national junior rodeo last week.
But, the young rodeo enthusiast, who will be a freshman at Caney Valley Jr.-Sr. High School, did get a huge dose of priceless experience and confidence on the national stage.
Carnes was a participant in the 4th Annual Wrangler Junior High Finals Rodeo held June 30 through July 5 in Gallup, New Mexico. He qualified for the Kansas team after earning high honors at a state competition in May.
Carnes competed in the team roping event, where he and partner Keaton Cole of Maize, Kan., finishesd in eighth place in performance, 20th place in the go round, and 48th place overall. Carnes was the header in the two-man roping team while Cole was the heeler.
The rural Dearing youth also competed in a shooting competition at the national rodeo that tested his marksmanship skills. He finished in 23rd place overall in a single event. In a separate shooting competition that involved his father, Mike Carnes, as a partner, the duo finished in eighth place overall.
“It was a good experience for me,” the younger Carnes said. “I enjoyed the rodeo and meeting all of the new people.”
Logan has been involved in rodeos since he was 8 years old, and he said he planned on competing in the youth rodeo circuit during the 2008-09 season, which begins in August.
Junior high and high school rodeos are a rarity in southeast Kansas, so Carnes has to travel to central and western Kansas destinations for most of the competitions. The closest junior high or high school rodeo to Montgomery County is held in Eureka, Kan.
Carnes’ father said the camraderie that is created on the youth rodeo circuit leads to tight-knit group of friends and family. That was shown on Memorial Day weekend when, preparing for the state junior rodeo competition, the younger Carnes discovered that his own calf roping horse had been killed by a lightning strike during a thunderstorm. With only a day or two before the state contest, Mike Carnes contacted fellow rodeo enthusiast Matt Yocham, who was in Arizona at the time. Yocham learned about the younger Carnes’ situation, found a horse that he thought was suitable for the state rodeo competition, and met the Carnes family at the state contest.
Logan Carnes had never ridden his new calf roping horse when he competed at the state rodeo, but crawling onto a saddle atop a new horse didn’t matter. His scores were good enough for him to finish among the top 10 in his event.
“That’s the great thing about rodeos: you meet friends and create a lot of camraderie with people,” said Mike Carnes. “They are always glad to help you out when you are in need.”
Even though he has been home for only a few days, Logan Carnes is preparing for another major rodeo event. Next week, he and team roping partner Madison Fields will compete at the legendary Pawhuska Cavalcade in Pawhuska, Okla., the largest amateur rodeo in the world.

Little Granton Bayless is a long way from knowing about the meaning of the Fourth of July.
But the 9-month-old baby declared his own brand of independence on the nation’s birthday last Friday, July 4, when a breathing tube and the last of five chest tubes were removed from his tiny body, giving family members and doctors at Children’s Mercy Hospital in Kansas City, Mo., a reason to celebrate.
It also offered a stronger ray of hope that the baby can crawl, coo and cry on his own without being followed by tubes and machines.
For in the world of Granton Bayless, celebrations are measured in the tiniest of increments.
The removal of one less tube, syringe or beeping machine is a major sign of improvement.
“These were big milestones,” said Granton’s grandmother, Deborah Bayless of rural Havana about the removal of the final chest tube and the respiratory machine. “This marked the first time that Granton was able to breathe on his own, and it was the first time that his family was able to hold him since he was admitted into the hospital several months ago.”
Granton Bayless is the infant son of Daniel and Jenni Bayless of Bolivar, Mo. Daniel is a native of Havana and was the first of seven Bayless children to attend Caney Valley schools. His parents, Dennis and Deborah Bayless, continue to reside in rural Havana.
Four months ago, doctors diagnosed Granton with a rare immunity disease called severe combined immunodeficiency, which prevents the body from producing enough blood cells necessary to fight off infections and disease. The condition is often dubbed the “bubble boy disease” because patients have to live inside a protective bubble for protection from germs and infections.
A patient at Children’s Mercy Hospital since late March, Granton’s frail little body became more fragile after pneumonia and a respiratory virus caused holes to form his lungs.
After being placed on a respiratory device and having as many as five chest tubes inserted to pull away the fluids and air leaking from his lungs, doctors were not optimistic about the chances for Granton’s survival. Medications were administered that intentionally paralyzed him so that he would not burn off the precious amounts of energy and oxygen inside his body.
Family members could touch Granton’s lifeless body inside a sterile incubator. But, they could not hold him — for two entire months.
Potential bone marrow donors were summoned to see if they were a match for a bone marrow transplant.
But, the prospects of Granton pulling through a perfect bone marrow transplant surgery were dwindling each day.
The atmosphere inside that pediatric care unit was grim.
That’s when the doctors made a last-ditch effort to save Granton’s life by putting him through a surgery that transplants blood cells from a donor’s umbilical cord. The fresh blood cells from an umbilical cord are intended to attack viruses and other harmful, infectious cells.
Since that transplant operation was performed on June 10, Granton has shown so many signs of improvement that doctors are labeling him a “miracle baby,” said Debbie Bayless.
“The doctors warned us ahead of the surgery that Granton would likely be on a respiratory for several months and that he would likely remain hospitalized even longer,” she said. “But, the new blood cells appear to be taking hold. And, we’re seeing signs of improvement each day. Removing him from the respirator and the last of his chest tubes was a huge step.”
Granton still has a long road ahead of him, Debbie says. Doctors said that a 100-day window from the day of the transplant is needed to see if the body will reject the influx of new virus-fighting blood cells. Today (Thursday) marks the 30th day of that 100-day timeframe.
Granton continues to be fed through a feeding tube, however doctors are toying with the idea of testing Granton’s swallowing skills to see if he is able to start taking food through the mouth. Should that occur, then the Bayless family can chalk up another major step in Granton’s recovery.
And, there is a chance that Granton will be moved from a pediatric intensive care unit to a transplant unit at Children’s Mercy Hospital, which is one more show of physical improvement, Debbie said.
“Right now, Daniel and Jenni are hopeful that Granton can be home by his first birthday in October,” she said. “But, there is a long road ahead of us for that to happen.”
Debbie said she, her husband and the remainder of the Bayless family have been overwhelmed by the show of support and prayer during the past several months. Thousands of letters have arrived at the hospital, many from strangers who offer their support and prayer to the family. Various fundraisers — from penny drives to cooking competitions — in Montgomery County as well as in Daniel and Jenni’s home in Bolivar, Mo., have raised thousands of dollars to offset various medical costs.

CHERRYVALE — In an attempt to combat rising fuel prices, all-terrain vehicles (ATV) and micro utility trucks (MUT) can be allowed on the streets of Cherryvale under an ordinance approved by city councilors on Monday.
However, before ATV and MUT drivers climb onto their vehicles and cruise the streets of Cherryvale, they’ll have to understand that the ordinance will require them to abide by all laws and regulations that conventional motorists must abide.
That means turn signals (or hand signals), lights, driver’s licenses and, in the case of ATV, the wearing of helmets for pilots and passengers under the age of 18.
The ordinance was written after several local residents approached city staff about possibly allowing ATVs and MUTs on city streets. Responding to the increase in fuel costs, the Kansas Legislature earlier this year approved legislation allowing MUTs and ATVs on city streets (golf carts and worksite utility vehicles are prohibited). The legislation also requires all motor vehicles to follow the traffic and traffic-related laws, which means possessing the proper safety features found on conventional vehicles plus having the operator be a licensed driver.
“We’re not giving free reign for ATVs to travel the city streets,” said police chief Matt Dennis at Monday’s city council meeting. “ATV and MUT drivers have to abide by all of the state laws regarding traffic and traffic safety.”
Dennis said it may be a matter of time before the legislature allows golf carts to be used on city streets. Many other states, including those in southern climates allow golf carts on city streets provided that the carts conform to local traffic standards.
The ordinance affects only the streets inside the city limits of Cherryvale, meaning that MUTs and ATVs cannot travel on federal and/or state highways outside the city limits unless to cross an intersection leading into the city limits. The Montgomery County Commission has not addressed the issue of MUTs or ATVs on rural county roads and are therefore prohibited on county roads.
Micro utility trucks, also known as MUTs, have being the new rage in the vehicle industry because of their small size and fuel efficiency. MUT vehicles are smaller than compact pickup trucks and are used primarily for localized utility purposes. They have smaller engines, which thereby produces greater fuel efficiency.
The new ordinance approved Monday defines a micro utility truck as “any motor vehicle which is not less than 48 inches in width, has an overall length, including the bumper, of not more than 144 inches, has an unladen weight, including fuel and fluids, of more than 1,500 pounds, can exceed 40 miles per hour as originally manufactured, and is manufactured with a metal cab.”
The ordinance defines all-terrain vehicles as “any motorized non-highway vehicle 48 inches or less in width, having a dry weight of 1,000 pounds or less, traveling on three or more low pressure tires, and having a seat to be straddled by the operator. Low pressure tire means any pneumatic tire six inches or more in width, designed for use on wheels with rim diameter of 12 inches or less, and utilizing an operating pressure of 10 pounds per square inch or less as recommended by the vehicle manufacturer.”
The ordinance, which was unanimously approved by councilors, is printed on page 14 in this edition of the Montgomery County Chronicle.
